This circular clarifies how transaction value is established where buyer and seller are related parties.
Declarants should be prepared to demonstrate that the relationship did not influence the price, using comparable sales, transfer pricing documentation or cost build-ups.
Where the declared value cannot be accepted, officers will apply the sequential valuation methods and record the basis of the decision on the declaration.
